Welcome to Lead Library (“we”, “our”, “us”). By accessing our website, purchasing our services, or receiving leads from us, you agree to be bound by these Terms & Conditions.
If you do not agree with these terms, please do not use our website or services.
About Lead Library
Lead Library provides lead generation, lead delivery, appointment setting, marketing campaigns, CRM integrations and related customer acquisition services for businesses operating within Australia.
Our services may include:
- Exclusive lead delivery
- Real-time lead notifications
- Appointment setting
- Marketing campaign management
- CRM integrations
- Industry-specific lead generation
- Lead nurturing campaigns
Eligibility
You must:
- Be at least 18 years of age
- Have authority to act on behalf of your business
- Provide accurate registration and contact information
- Comply with all applicable Australian laws and regulations
Lead Delivery Services
Lead Library supplies prospective customer enquiries (“Leads”) based on agreed campaign parameters.
While we endeavour to provide high-quality opportunities, we do not guarantee:
- Conversion rates
- Sales outcomes
- Revenue generated
- Appointment attendance
- Customer purchasing decisions
Lead performance will vary based on factors outside our control including pricing, customer needs, market conditions and sales processes.
Lead Acceptance
A Lead is considered delivered when:
- Submitted through your CRM
- Sent via email
- Delivered via SMS notification
- Received through an integrated platform
- Provided through any agreed delivery method
Delivered leads are deemed accepted unless a replacement request is submitted within the timeframe outlined in Section 7.
Exclusive Leads
Where services are described as “Exclusive”, Lead Library will not intentionally distribute the same lead to multiple clients within the same service category.
Exclusive status applies only to Lead Library’s distribution practices and does not guarantee:
- The prospect has not contacted other providers independently
- The prospect has not completed enquiries elsewhere
- The prospect is actively seeking only one supplier
Client Responsibilities
Clients are responsible for:
- Prompt lead follow-up
- Maintaining all required licences and certifications
- Complying with privacy and marketing laws
- Providing accurate campaign requirements
- Maintaining CRM and communication systems
- Training staff to manage enquiries effectively
Lead Library is not responsible for outcomes resulting from delayed follow-up or internal business processes.
Lead Replacement Policy
Replacement requests may be considered for leads that:
- Contain invalid contact information
- Are clearly duplicated by Lead Library
- Fall outside agreed geographic areas
- Fall outside agreed service criteria
Replacement requests must:
- Be submitted within 5 business days of delivery
- Include supporting evidence
- Be reviewed by Lead Library before approval
The following are not valid replacement reasons:
- No answer from the prospect
- Prospect no longer interested
- Prospect selected a competitor
- Pricing objections
- Appointment cancellations
- Failure to contact promptly
Replacement decisions remain at Lead Library’s reasonable discretion.
Marketing Campaign Services
Where Lead Library manages advertising campaigns:
- Campaign performance cannot be guaranteed
- Advertising platform policies may affect delivery
- Platform outages and account restrictions may impact results
- Lead volume estimates are indicative only
Clients remain responsible for reviewing campaign performance and approving significant changes where required.
CRM & Integration Services
Lead Library may provide CRM setup, integrations and automation services.
While reasonable care is taken:
- Third-party platforms may change functionality
- Integrations may occasionally fail
- System outages may occur
- External software providers remain responsible for their services
Clients are responsible for maintaining active subscriptions with third-party providers.
Fees & Payments
All fees are quoted in Australian Dollars (AUD) unless otherwise stated.
Invoices must be paid according to agreed payment terms.
Failure to pay may result in:
- Suspension of services
- Delayed lead delivery
- Cancellation of campaigns
- Recovery action for overdue amounts
Outstanding balances may incur reasonable collection costs where permitted by law.
Refund Policy
Due to the nature of digital lead generation services, fees paid are generally non-refundable.
Refunds may only be provided where required by Australian Consumer Law or where Lead Library determines, at its discretion, that a refund is appropriate.
Intellectual Property
All content on this website, including:
- Branding
- Logos
- Designs
- Written content
- Graphics
- Processes
- Marketing materials
remains the property of Lead Library or its licensors.
No content may be reproduced without prior written consent.
Confidentiality
Both parties agree to keep confidential information private and not disclose it to third parties unless:
- Required by law
- Necessary for service delivery
- Agreed in writing
Confidential information includes business strategies, pricing, campaign data and customer information.
Privacy
Collection and handling of personal information is governed by our Privacy Policy.
By using our services, you consent to the collection and processing of information necessary to provide our services.
Australian Consumer Law
Limitation of Liability
To the maximum extent permitted by law, Lead Library shall not be liable for:
- Loss of revenue
- Loss of profits
- Loss of business opportunities
- Indirect damages
- Consequential damages
- Data loss
- Reputation damage
Our total liability for any claim relating to our services shall not exceed the fees paid by the client during the preceding three-month period.
Website Use
Users must not:
- Attempt to gain unauthorised access to systems
- Introduce malicious software
- Copy or reproduce website content without permission
- Interfere with website operation
We reserve the right to restrict access where misuse occurs.
Termination
Either party may terminate services in accordance with any agreed service agreement.
Lead Library may suspend or terminate services immediately where:
- Payments remain overdue
- Fraudulent activity is suspected
- Laws or regulations are breached
- These Terms are materially violated
Changes to These Terms
Governing Law
These Terms & Conditions are governed by the laws of Australia and the State of Queensland.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
